INFORMATION CLAUSE

Below i provide information on the rules of processing your personal data by Monika Macura in the scope of the services she provides under the firm Kancelaria Radcy Prawnego Monika Macura (hereinafter: "Firm"), as well as on the website www.kancelariamacura.pl (hereinafter: "Website").

The information is provided on the basis of Article 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 94/46/EC (hereinafter: "GDPR").

2. PURPOSES AND LEGAL BASIS OF PROCESSING PERSONAL DATA

Your personal data will be processed by the Controller for the following purposes:

  1. for the purpose of properly performing the contract for the provision of electronic services by the Controller, on basis of Art. 6 p. 1 lit. b) GDPR;
  2. for the purpose of proper performance of the contract in terms of the services provided by the Controller, on the basis of Art. 6 p. 1 lit. b) GDPR;
  3. for the purpose of correctly complying with the Controller's obligations arising from generally applicable law, in particular concerning the rules of practice of the profession by legal advisers, including their obligations to clients, the professional body or public authorities, on the basis of Art. 6 p. 1 lit. c) GDPR;
  4. for the purpose of initiating or conducting business contacts, on the basis of Art 6 p. 1 lit. f) GDPR;
  5. for the purpose of sending a newsletter with marketing content to persons who are Controller's clients, on the basis of Art. 6 p. 1 lit. b) GDPR;
  6. for the purpose of sending a newsletter with marketing content to persons who are not Controller's clients, on the basis of Art. 6 p. 1 lit. f) GDPR;
  7. for the purpose of direct marketing of the services provided by the Controller to clients, on the basis of Art. 6 p. 1 lit. f) GDPR;
  8. for the purpose of direct marketing of the services provided by the Administrator to non-clients, on the basis of Art. 6 p. 1 lit. a) GDPR;
  9. for the purpose of replying to a message received electronically or by traditional post, on the basis of Art. 6 p. 1 lit. f) GDPR;
  10. for the purpose of answering a question described during a telepone contact with the Controller, on the basis of Art. 6 p. 1 lit. f) GDPR;
  11. for the purpose of carrying out the recruitment process, including future recruitment processes, on the basis of Art. 6 p. 1 lit. a) GDPR;
  12. for the purpose of analysing the use of the Site, improving its functioning and security, on the basis of Art. 6 p. 1 lit f) GDPR;
  13. for the purpose of dealing with complaints, defending against claims made by you that may arise in connection with the provision of services by the Administrator, including electronic services, or in relation to the processing of your personal data, on the basis of Art. 6 p. 1 lit. f) GDPR.

3. SOURCE OF THE PERSONAL DATA

The Controller collects your personal data directly from you.

In addition, personal data are automatically collected in connection with your use of the Website.

4. DATA TYPE

I. Data collected directly from you:

Provision of legal services
In order to provide legal services with the utmost care, the Administrator processes your identification data such as name, address, PESEL number, as well as contact data in the form of telephone number and e-mail address. In addition, the Controller processes data contained in the documentation received from you. The above data may also include your employees and co-workers who contact the Controller or its employees or co-workers on your behalf directly.

Contact with the Controller
The Controller collects data provided by you in the content of the message addressed to the controller. Depending on the path of contact chosen by you, your contact details will also be collected, as well as - in the case of contact via traditional post - your identification data.

Newsletter
The Controlles processes your e-mail address.

Recruitment
The Controller processes the data contained in the Curriculum Vitae (CV) and optionally in the motivation letter received from you, including identification data, contact details and professional qualifications.

II. Data collected automatically, not derived directly from you
For the purpose of ensuring the secure functioning of the Website, as well as your safety as a user, the Controller processes certain personal data automatically. This data includes in particular IP addresses, location, parameters of the hardware and software used by you, device identification numbers.

III. Data contained in cookies
Cookies used on the Website fulfil a number of important functions. In particular, their use makes it possible to ensure the best possible level of availability of the services offered by the Controller, as well as to personalise the content displayed to you and to improve the functionality of the Website.

5. DATA RECIPIENTS

6. TRANSFER OF DATA TO A THIRD COUNTRY OR AN INTERNATIONAL ORGANISATION

Your personal data will not be transferred to a third country or an international organisation.

7. AUTOMATED DECISION-MAKING, INCLUDING PROFILING

Your data will not be processed automatically, including profiling.

8. PERIOD OF RETENTION OF PERSONAL DATA

Your personal data will be processed:

  1. for the purpose of properly performing the contract for the provision of electronic services - for the duration of the contract for the provision of electronic services;
  2. b) for the purpose of proper performance of the contract - for the duration of the contract;
  3. for the purpose of correctly complying with the Controller's obligations arising from generally applicable law - for the period necessary to prove that the Controller performed those obligations correctly;
  4. for the purpose of initiating or conducting business contacts, for the duration of the business contact;
  5. for the purpose of sending the newsletter with marketing content to Controller's clients - personal data will be processed for the duration of the contract or until you raise an objection;
  6. for the purpose of sending the newsletter with marketing content to persons who are not Controller's clients and who voluntarily agreed to receive the newsletter - personal data will be processed until withdrawal of consent to receive the newsletter;
  7. for the purpose of direct marketing in relation to persons who are Controller's clients - personal data will be processed until the end of the contract or until you raise an objection;
  8. for the purpose of direct marketing to non-clients - personal data will be processed until you withdraw your consent;
  9. for the purpose of replying to a message received electronically or by traditional post, personal data will be processed until the correspondence with you is concluded;
  10. for the purpose of answering a question described during a telephone contact with the Controller - personal data will be processed until the end of the telephone conversation;
  11. for the purpose of carrying out the recruitment process, including future recruitment processes - personal data will be processed until you withdraw your consent;
  12. for the purpose of analysing the use of the Website, improving its functioning and security, for a period of 3 years from the receipt of the data;
  13. for the purpose of considering your complaints, defending against claims that you may have in connection with the provision of services by the Controller, including electronic services, or with regard to the processing of your personal data - until your potential claims against the Controller expire.

9. YOUR RIGHTS REGARDING THE PROCESSING OF DATA

You have the right of access to your data and the right to request their rectification if inaccurate, their erasure or the restriction of their processing.

To the extent that the processing of your personal data is based on a legitimate interest of the controller, you have the right to object to the processing of your personal data.

To the extent that the processing of your personal data is based on consent, you have the right to withdraw your consent at any time. Withdrawal of consent shall not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.

If you have consented to receive commercial information via e-mail, you have the right to withdraw your consent, for example by sending an e-mail to: kancelaria@kancelariamacura.pl.

To the extent that the basis for the processing of your personal data is Art. 6 p. 1 lit. a) or 6 p. 1 lit. b) of the GDPR and the processing is carried out by automated means, you also have the right to receive personal data from the Controller, in a structured, commonly used and machine-readable format, you may also send this data to another controller.

10. THE RIGHT TO COMPLAINT TO THE SUPERVISORY AUTHORITY

You also have the right to make a complaint to the supervisory authority dealing with personal data protection, which is the President of the Office for Personal Data Protection.

11. INFORMATION ON THE VOLUNTARY OR OBLIGATORY NATURE OF PERSONAL DATA

The provision of data is voluntary.
