Legal advice on the provision of an innovative mobile application and multi-currency debit card product service

The firm provides ongoing legal services to the client including, inter alia, legal advice on the payments services provided throughout an innovative mobile app product and a multi-currency debit card. The mobile application allows the user to convert a virtual currency into a currency of the client’s choice and to top up the debit card with such funds. This card, as a payment instrument, enables the user to make any kind of payments and withdraw funds at an ATM.

The client offers the card on its own behalf and also as a provider of infrastructure and technology to others (in a whitelabel model). The firm advised on the creation of the legal documentation of the mobile application (regulations for the provision of the mobile service), as well as we provided an opinion on the proces of the client’s use of methods and identity identification and verification and ongoing monitoring of customers and transactions. The firm also advised on the conclusion of an agreement to entrust identity verification processes using video verification.

The firm has also drafted contracts for the provision of services by the client to its whitelabel business partners and negotiates the content of these contracts.

By conducting legal services for the client we demonstrate expertise of payment services, AML/CFT and personal data processing and advanced English language skills.

DORA implementation

We continue to work with the client – a leading payment institution. Due to changes in the legal environment and the commencement of application of Regulation (EU) 2022/2554 of the European Parliament and of the Council of December 14, 2022 on the operational digital resilience of the financial sector and amending Regulations (EC) No. 1060/2009, (EU) No. 648/2012, (EU) No. 600/2014, (EU) No. 909/2014 and (EU) 2016/1011 (the DORA Regulation), the client asked us to prepare the necessary documentation and adapt its operations to the requirements of the DORA Regulation.
