Payment application

We cooperate with a fintech company that furnishes cross-border payment solutions together with the technological infrastructure necessary to support them. As a part of our ongoing legal support for the client, we acted as lead counsel on the deployment of an international mobile application that unifies client’s conventional payment services with virtual-asset functionalities offered by the company and its commercial partners; the cornerstone of the product is a payment card that can be loaded directly with cryptocurrencies and thereafter used on standard card rails.

The engagement requires comprehensive preparation and negotiation of all contractual and regulatory documentation indispensable for the launch. Our team drafted and settled the principal technology-integration and service agreements, the end-user terms and conditions, and all ancillary documents including internal policies, while simultaneously designing the end-to-end compliance flow in conformity with PSD2, the Anti-Money-Laundering Directive, and the forthcoming Markets in Crypto-Assets Regulation (MiCA).

Given the application’s multi-jurisdictional reach, the entire corpus of documentation was produced in parallel Polish and English versions, and all project communication was conducted in English. We provided comprehensive legal support in a technically and legally complex FinTech matter, ensuring the project met all applicable regulatory standards across financial services.

DORA implementation

We continue to work with the client – a leading payment institution. Due to changes in the legal environment and the commencement of application of Regulation (EU) 2022/2554 of the European Parliament and of the Council of December 14, 2022 on the operational digital resilience of the financial sector and amending Regulations (EC) No. 1060/2009, (EU) No. 648/2012, (EU) No. 600/2014, (EU) No. 909/2014 and (EU) 2016/1011 (the DORA Regulation), the client asked us to prepare the necessary documentation and adapt its operations to the requirements of the DORA Regulation.
